Terms and Conditions


  1. The premises are let to you for holiday purposes only for the period stated on the receipt.
  2. Tariffs advertised on the paradiseinpalmcove website and other ‘holiday letting’ websites are current and subject to change without notice.
  3. The premises are available from 2pm on the day of arrival and are to be vacated by 10am on the day of departure, unless otherwise agreed in writing by the owners. Keys are to be left inside the apartment upon departure; failure to leave the keys inside the apartment will result in the cost of a Locksmith to change the locks being deducted from the bond. Entry into and from the apartment will be notified in writing via a 'Welcome Book' once flights or arrival times are advised by the guest.
  4. A bond for the keys to the apartment is required from all guests and is equal to one night of the accommodation at the time of booking (see applicable seasonal rates) or 10% of the total invoice amount (whichever is greater). This payment is received as a security deposit and must be paid in full before the final invoice is due.  The security bond cannot be deducted from the final invoice, if the security bond is deducted from the final invoice the accommodation can be forfeited. A notice in writing will occur first with the opportunity to remedy the under payment.

    Once the keys have been collected and the property is checked and found to be in good order without missing or damaged items, the security bond will be refunded into the account nominated within 7 days, less any PayPal, international transfer fees or local fees applicable depending on the method of payment. If you pay by PayPal your deposit less PayPal fees will be refunded back through PayPal.
  5. Access to the apartment on the booking date is available if the final invoice has been paid in full, occupancy will not occur prior to the booking date. The owner reserves the right to refuse or cancel any bookings where the bond and full payment is not received by the due dates. The confirmation of the booking date will apply when full payment of the security bond is received.
  6. Pets are not permitted on or about the premises.
  7. Please ensure all windows and doors are locked when leaving the apartment and also prior to departure.
  8. Please avoid unnecessary noise and behaviour that may disturb or distress neighbours and resort guests.
  9. The smoke detectors in the apartment can be sensitive to moisture and dust. To ensure smoke detectors are not activated, please observe the following:
  10. Smoking is not permitted inside the apartment. Smoking is permitted on the balcony with all doors closed to prevent smoke entering the apartment and activating the smoke detectors.
  11. When you leave the apartment turn off all air conditioners. This will prevent moisture build up in the smoke detectors which can activate them.
  12. Set the remote control at no less than 21 degrees celsius on all air conditioner remotes, (this is recommended by the local fire department) because moisture can build up inside the smoke detectors if the temperature is set too low.
  13. When using the toaster, place it on the bench next to the stove and put the range hood fan on to remove any smoke and please take care not to burn the toast.
  14. Refrain from cooking at high temperatures, as it may cause your food to burn and create smoke in the apartment.
  15. For your convenience Paradise in Palm Cove has installed a triple lock front security door which enables tenants to leave the front door open and enjoy the lovely sea breezes throughout the apartment.
  16. The property is rented to accommodate only the number of persons specified in writing by the Owner. House guests are STRICTLY not permitted to stay in the apartment without written consent by the owner and must be arranged at the time the booking is confirmed and prior to the final payment.
  17. Occupants must allow the Property Manager and its representatives of Paradise in Palm Cove, access to the property to carry out any necessary repairs.
  18. Any damage, breakage or loss to the property and its furniture, furnishings, equipment and keys is to be reported to our office immediately. The tenant will be responsible for any damage incurred to the property by them or their guests and Paradise in Palm Cove reserve the right to withhold part or the entire Bond as described in section 4 to cover such damage and to pursue the occupants for any additional damage not covered by the Bond amount.
  19. Property descriptions are made in good faith. We take no responsibility for typing errors, omissions or misdescriptions; however, we endeavour to ensure this does not occur. The apartment's location on Coral Coast Drive in reference to the Grand Chancellor Hotel and proximity to tourist activities is provided to the best of our knowledge at the time, we take no responsibility for approximate time and distance estimations, should they vary.
  20. All bookings are made in good faith but in extreme circumstances may be subject to changes prior to the commencement of the booking. Situations that can occur but are not limited to, in the event of a cyclone or unusual weather condition where vacant possession of the property is required, alteration of the property or withdrawal of the property from letting. We will endeavour to find alternative accommodation on the resort should this occur. Where similar accommodation on the Coral Coast Resort is not available, a full refund of all monies paid will be reimbursed back to you with the maximum amount of notice applicable.
  21. We cannot accept responsibility for personal possessions left on the premises. Please ensure you check the premises before departing. A minimum $15.00 plus postage fee will be payable for recovery of any items left at the property.
  22. The Property Manager cannot accept responsibility for the furnishings, fittings and house equipment which are Paradise in Palm Cove’s responsibility and personal taste. Paradise in Palm Cove ensures that the apartment is well maintained in good condition and clean upon arrival and departure.
  23. Where appliances or furniture breaks down due to wear and tear, the lessee must inform the Property Manger by phone or email as soon as the defect is noticed. The Property Manger or owners of Paradise in Palm Cove will respond by phone or in writing within 24 hours of the notification to confirm action taken to remedy the defect. The lessee must allow reasonable time for the Property Manager, trades or maintenance personnel to gain access to the apartment to inspect and carry out any necessary repairs.
  24. No compensation or refunds will be given for:
  • appliances, equipment or furniture that breaks down as a result of age, wear and tear that is unforseen. It is the owner's responsibility to remedy the faulty appliance and equipment at the earliest time agreed to by the guests and owners if the remedy must occur during occupancy.
  • If the lessee refuses access to the apartment for the purpose of assessment and repair or is continuously unavailable at the agreed period stated in writing as advised by the owner.
  • In the event of any renovation/building work being carried out near the holiday premises, such work is beyond the control of the Property Manager and owner, and cannot accept responsibility for any disturbance, noise or inconvenience guests may suffer as a result.

          No discount will be negotiated for any of the above

  1. The owners and Property Manager reserve the right to cancel the holiday accommodation, where a complaint involving law enforcement occurs. Under these circumstances the Lessee forfeits their right to a refund for causing a civil disturbance.
  2. Failure to observe the above terms and conditions will grant the Property Manager the immediate right to terminate any booking or occupancy. Absolutely no refunds will be given under these circumstances.
  3. The property is let for holiday purposes only; it is not let for permanent rent and is therefore not subject to the same contractual obligations of a long-term rental property. Functions, house guests staying for the duration of the holiday accommodation, parties and pets are strictly not permitted. The rules applicable are as per the Body Corporate ‘Strataware’ which govern the resort and are applicable to all other guests staying on the Resort.
  4. If there is any damage or faults within the property, please contact our office immediately or the Paradise in Palm Cove Property Manager.


  • If a booking is cancelled greater than one month from the arrival date, the deposit will be refunded less any bank fees incurred for processing and returning the deposit.
  • If a booking is cancelled less than one month prior to arrival, the deposit and final payment (if it has been paid) is non refundable. Unless we receive payment from another booking over the same dates, then the deposit less 25% administration fee will be returned including the final payment.
  • If a booking is cancelled by the lessee on the day of arrival for any reason, the final payment is non refundable and non negotiable.
